| 1.Application |
|
The following provisions apply to FORUM8
products that you purchased.
FORUM8 products include computer program,
program medium, protect and program manual
supplied in this package etc, hereinafter
referred to as "Products ". )
The Products are protected by copyright laws
and international copyright treaties, as
well as other intellectual property laws
and treaties. The Products are licensed,
not sold.
FORUM8 owns copyrights in Products. |

| 2.Grant of License |
|
1) |
You may use Products on a single computer
that you specify on "user registration
card" and that is thereby registered
with FORUM8.
However, only to the extent that FORUM8 grants
the use of Products on a LAN, you may make
Products available on machines registered
that belong to the LAN.
The number of machines on a LAN shall be
agreed upon prior to the grant of license. |

2) |
You shall not assign, transfer, dispose of,
sell, rent, or lease Products for any reason
whatsoever. |
|
3) |
You shall not rent or lease Products whether
or not you receive any consideration. |
|
4) |
You shall not copy, reproduct Products. |
|
5) |
You shall not analyze, decompile, reverse
engineer, disassemble, change or modify Products
without the prior permission of FORUM8. |
|
6) |
Computer program is licensed as a single
product.
Its component parts may not be separated
for use on more than computer. |
|
|
| 3.Revision of Products |
|
1) |
We sometimes carry out the revision of Products.
(the addition of function, the improvement
of input-output etc.) |
|
2) |
The customer who has the license hereby may
exchange Products for revised Products with
the charge that is provided separately. |
|
|
| 4.Range of warranty |
|
1) |
If there is defectiveness in the record medium
of the program, or if there is a missing
page, erratic pagination in the manual attached
to product etc, FORUM8 will replace them
at no charge within the period of one (1)
month commencing with the day of receipt. |
|
2) |
FORUM8 DISCLAIMS ALL OTHER WARRANTIES, EXPRESS
OR IMPLIED, INCLUDING MERCHANTABILITY AND
FITNESS FOR PARTICULAR PURPOSE. IN NO EVENT
WILL FORUM8 BE LIABLE TO YOU FOR ANY DAMAGES,
INCLUDING LOST PROFITS, OTHER INCIDENTAL
OR CONSEQUENTIAL DAMAGES ARISING OUT OF,
OR RELATING TO YOUR USE OR INABILITY TO USE
PRODUCTS, OR FOR ANY CLAIM BY ANY OTHER PARTY. |

3) |
In no event will FORUM8 be liable to you
for the damage caused by a computer virus.
You shall check or exterminate a computer
virus by yourself. |
|
4) |
Only when you fill in the "user registration
card" and return it to FORUM8, you may
receive the following support service for
customer.
However, we shall terminate it in one (1)
year commencing with the day of purchase.
- We send you the information on revisions
and new products in our company.
- "Support Center" answers the technical
question about Products.
- If you have damaged the medium of Products,
we shall replace them at the charge provided
separately.

| 5.Agreement period |
|
1) |
This agreement comes into effect when you
receive and open Products. |
|
2) |
If you violate any clause of this agreement,
this agreement will be automatically terminated
and you shall return Products to FORUM8. |
|
3) |
In case of the foregoing 2), We do not return
the price of Products to you. |
|
|
| 6.Governing Law |
|
This agreement is governed by the laws of
JAPAN. |
|
|
| [About the Viewer version] |
|
Program file itself is same between the Products
version and Viewer version .
(However, there is the difference in functions
that the following " Function of the
Viewer version " specifies.)
You may distribute Viewer version by copying
the program files from the product CD to
floppy-disk etc. |
|
|
| Function of the Viewer version |
|
You are not able to execute the following
processing unlike the Products
version.
- The input/modify of data
- The export of data
- The print of data (including the output in
the HTML form)
Except for the foregoing, the function concerning
the calculation and the display are the same
as the Products version. |
|
|
| Support to the Viewer version |
|
- Inquiry
Although the user of the Vewer version also
may inquire to the Support Center about the
Vewer version, the range of the support is
more limited than that for the customer who
purchased the Products version.
- Renewal information
We inform the customer who purchased the
Product version of the renewal information
about the program.
We do not inform the user of the Viewer version
of the renewal information about the program.
Please check out the latest version of the
program in our company homepage etc.

| 1.Grant of license |
|
On condition that you agree with this license
agreement, our company grants a license to
use the Viewer version program.
You do not have to notify our company of
this license. |

|
| 2. Prohibition |
|
Our company prohibits the following.
| 1) |
To assign, transfer, sell, sublease the license
to use the Viewer version . |
| 2) |
The reproduction or copy of part, or all
of Products, manual attached etc except for
the following.
- Reproduction for backup purposes.
- Reproduction for distribution on condition
that is specified in another clause ([About
the Viewer version]).
- The installation to use the Products
|
| 3) |
Reproduction to BBS, Web etc. |
| 4) |
Rental, suspected rental |
|
|
|
| 3.Termination of the license |
|
In case of the following, the license terminates.
In case that the license terminates,
the
user shall delete, nullify the
program.

| 4. limited warranty |
|
If you purchase the medium of the Viewer
version program from FORUM8 and there is
defectiveness in the record medium, we replace
it at no charge for the period of one(1)
month commencing with the day of receipt. |

| 5. other warranty |
|
| 1) |
FORUM8 DISCLAIMS ALL OTHER WARRANTIES, EXPRESS
OR IMPLIED, INCLUDING MERCHANTABILITY AND
FITNESS FOR PARTICULAR PURPOSE. |
| 2) |
IN NO EVENT WILL FORUM8 BE LIABLE TO YOU
FOR ANY DAMAGES, INCLUDING LOST PROFITS,
OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGE
ARISING OUT OF, OR RELATING TO YOUR USE OR
INABILITY TO USE PRODUCTS, OR FOR ANY CLAIM
BY ANY OTHER PARTY. |

Our company does not have the obligation
to support the user of the Viewer version
at all. |

|
|
| 6. About inquiries |
|
When you have any question (including the
technical contents) about the program of
which you are considering the purchase, please
inquire to FORUM8 sales representative about
it. |
|
|
| 7. Governing Law |
|
This agreement is governed by the laws of
JAPAN. |
|
|
| ［CG Data License Agreement］ |
|
| 1. Application of the Agreement |
|
This agreement is a license agreement for client users of FORUM8 Co., Ltd's
UC-win/Road data, 3D model data, and texture data (hereafter called "CG
data"). This agreement shall be effective upon initial use of the
CG data by the client. |
|
|
| 2. Copyright and License |
|
| 1) |
General Issue |
| FORUM8 Co., Ltd shall own the copyright of the CG data which FORUM8 Co.,
Ltd. provides as a product, and its entailing service. A client who has
purchased the product or service shall own the right to use it nonexclusively.
The client shall not distribute or lease the product of service without
authorization of FORUM8 Co., Ltd. |
| 2) |
Produced and Edited CG data |
| Clients can produce, edit, and add to the CG data at their discretion.
In these cases, the clients shall own the copyright of the part that they
have produced, edited, and added. Since they own the copyright, they can
use these for public announcements, presenting research papers at meetings,
and sales activities, as their own CG products. However, FORUM8 Co., Ltd.
has given up no copyright of the CG data as a whole. Clients shall require
the authorization of FORUM8 Co., Ltd. when they use UC-win/Road CG data
for sales activities, such as distributing or leasing CG data to the public. |
| 3) |
CG Data Creation Sold as a Service |
| FORUM8 Co., Ltd. shall not present, sell, or lease the CG data provided
or sold to clients as exclusive (non-public) without the clients' prior
authorization. However, if the CG data contains FORUM8's copyrighted data,
FORUM8 Co., Ltd. owns the copyright of for those parts of the data. FORUM8
Co., Ltd. shall own the copyright of the CG data provided or sold to clients
as non-exclusive (public) after a pre-defined period (if applicable). |
| 4) |
Data Concerning Third Parties |
| Limited use conditions can be applied to clients if the CG data - provided
by FORUM8 Co., Ltd. as a product and service - contains rights of third
parties such as trademark rights, patent rights, rights to use, or rights
of portrait. In these cases the scope of alternation and use by clients
may be limited. Please keep this in mind. |

| 3. Disclaimers |
| 1) |
The intellectual property rights of the CG data obtained, purchased, produced,
edited, and so forth, by clients, and any damages caused by the use of
the data, are within the scope of clients' responsibility. FORUM8 Co.,
Ltd shall take no responsibility for any disputes with third parties concerning
these rights and damages. Please keep this in mind. |

FORUM8 Co., Ltd. shall take no responsibility for damages caused by defects
in or use of the CG data. The same applies to edited or altered CG data. |

| 4. Revision, Support, and Miscellaneous |
|
These issues shall conform to the "program license agreement"
established by FORUM8 Co., Ltd. |
|
|
